Case of the Week: Tax Efficient Strategies for ILITs

The SituationHow to pay the premiums on a life insurance policy owned by an ILIT without the gift taxes generally associated with such an arrangement. Depending on the facts and circumstances of the case, there may be a multitude of options available– annual exclusions, lifetime exemptions, private split dollar, or premium financing.  In some cases, gifting money to the ILIT is all it takes.  Alternatively, there are situations when there are no annual gifts or lifetime exemptions available.  Or, perhaps the premiums are so large that traditional techniques would be ineffective.  At some point, the options become overwhelming.
